AFM and AMKA are going to be replaced – What is the Personal Number, the 7 digital changes

The Digital Governance Code, which is expected to be consulted in Parliament in the coming days, brings radical changes in the lives of Greeks .

New habits, fewer procedures and especially less bureaucracy are promised by the new bill of the Ministry of Digital Government, in which, among other things, a legal framework is promoted for the Single Citizen, digital signatures, digital stamps, digital documents.

Kyriakos Pierrakakis, Minister of Digital Government, spoke to the Athenian-Macedonian News Agency about the usefulness and key role of the Code , emphasizing that “when we started planning our digital strategy, we immediately realized that, in addition to the necessary legislation codification of the existing framework so that everyone knows clearly what is going on. We did not want there to be a single incident of denial of service by a public service, because no interpretative circular had arrived. The Digital Governance Code comes to answer these two questions : to update and unify the legislation on digital governance. ”

Seven changes to the digital governance codes
Specifically, the seven most important innovations that directly concern the citizen are:

Institutionalization of Personal Number (PA) for the citizens (a) A personal number (PA) is established for the identification of natural persons, in order to provide services by public and wider public sector bodies. The PA is assigned once to the natural person and is not changed. (B) The PA is assigned to each natural person entitled to Tax Registration Number ( ΑΦΜ)) or Social Security Registration Number (AMKA). For those individuals who have been awarded VAT, this is the PA. Individuals who have been assigned only AMKA are assigned the PA according to a procedure set out in a decision. (C) The PA does not automatically imply the granting of rights or the imposition of obligations on its holder. The terms and conditions for the rights and obligations of the holder of the PA are regulated by the current tax, labor and insurance legislation. (D) The PA will replace the ΑΦΜ of individuals and the AMKA gradually and with full replacement within two years

Establishment of an e-delivery system The e-delivery system is introduced: what constitutes today’s registered mail can be the e-delivery service for the electronic world. The goal is to be a secure electronic “communication channel” of the State with the citizens and the companies. Until now, the above service, although provided for in the European regulations, has remained unused. The Digital Governance Code creates the conditions for development in both the private and public sectors. In particular, the State is provided with new possibilities for electronic public interface and citizens / businesses. The goal is for the audit to be done electronically.

Institutionalization of the Register of Public Administrative Procedures . This Register shall contain all digital or physical procedures of the Public Sector, regardless of whether they concern the provision of public service to citizens or private sector bodies or internal procedures of the Public Sector. There can be no deviation in the application of the procedure by any competent public service. This means that the citizen can know with certainty the process required for his transaction with the State without being exposed to phenomena of arbitrariness and unnecessary bureaucracy.

Institutionalization of the Citizens’ Communication Register . It is the only point of the Public Administration, where the citizen will declare his contact details (address, telephone, email). All public bodies will use this register exclusively to be informed of the citizens’ contact details, without the citizens being required to state or update their contact details separately to each institution.

Strengthening the Single Digital Portal ( ) The new tool for real digital governance, the exclusive portal for providing digital services to citizens / businesses, was established by Article 52 of Law 4635/2019. Furthermore, further regulations are introduced for its operation, basic elements: possibility of issuing documents / applications by natural persons, strong methods of authentication so that there is maximum certainty about the identity of the natural person used by each service)

Obligation to provide digital public services under the umbrella of the EPP ( ) The Unified Digital Portal of the Public Administration ( – EPS) is the exclusive portal for the provision of digital public services to citizens / businesses. Further regulations are introduced for its operation with key elements the possibility of issuing documents / applications by natural or legal persons and the establishment of strong methods of verifying the identity of the person traded (authentication), so that there is maximum certainty about the identity of the person using each service.

Permanent digital services established by PNP to address the effects of the COVID-19 crisis

Its provisions are codified by 20.3.2020 PNP for the first digital public services through the EDP: (a) Electronic responsible statement (b) Electronic authorization (c) intangible prescription (d) KYC. Henceforth, the physical presence of the citizen in the competent authorities is not required for the authenticity of the signature to be validated in responsible statements and authorizations, as the authentication made for the use of the digital public services of the NTUA has the same validity as the authentic signature of the article. 11 of Law 2690/1999 (A ’45). This is an innovation necessary to provide digital services with the guarantees required by the existing provisions on administrative action.
