Anti-smoking law: Where the cigarette is finally banned – New Provisions

On Tuesday, the House passed a wide majority of anti-smoking laws and smoking is now banned in all public places. This is the third anti-smoking law passed by the House and now everyone is waiting to see if it will be implemented and whether smokers and businessmen will be disciplined.

However, it is worth noting that one of the key provisions of the new institutional framework is the active involvement of the police (which nonetheless reacts) in the enforcement of anti-smoking legislation.

It is noted that the universal ban on cigarettes and smoking in public places has been a priority issue of Kyriakos Mitsotakis since the pre-election period.

The new provisions of the anti-smoking law will come into force immediately after their publication in the Government Gazette in the coming days. It is recalled that among the provisions of the anti-smoking law are:

The possibility of creating smoking areas, which may not exceed one-half of the total casino area, and live music venues of more than 300 sq. M. planned annual fee of two hundred euros per square meter for the creation of these sites.

The ban on tobacco consumption extends to indoor sports venues and outdoor sports venues.

It is also envisaged to impose fines, but also to seal the premises of owners of entertainment centers that do not comply with the law.

The government wants a total ban on smoking in all public indoors, as it is in most European countries. In order for the law to be implemented properly and universally, it is expected that the controls will be intensified and a hotline to report violations within the next six months.


According to the previous law smoking is prohibited in:

institutions of all kinds and levels,

Priority educational institutions: kindergartens and elementary schools, elementary schools, special schools, secondary education of all types, Universities, Higher education institutions, all kind of technical education facilities, private educational facilities,

sports facilities,

health stores (restaurants, cafes)

entertainment centers, etc.,

Anti-smoking law and fines – What the circular said

Infringement of the prohibition on smoking by public officials, civil servants, civil servants and civil servants in the places where their services are established constitutes a disciplinary offense and is punishable in accordance with the provisions. governing their disciplinary responsibility.

Anyone who smokes or consumes tobacco products in breach of Article 3 shall be fined fifty (50) to five hundred (500) euros, taking into account any possible recidivism.

Any person responsible for the management and operation of the premises referred to in the first paragraph of Article 3, who is found to be in breach of the provisions of Article 3, shall be fined from five hundred (500) to ten thousand (10,000) euros, taking into account any possible infringement. In the fourth recurrence the authorization of the health care shop was temporarily revoked by a decision of the authority which granted it for a period of ten (10) days, and in the fifth recurrence the authorization by the authority which granted it was permanently revoked.

Anyone who sells tobacco products to minors or tolerates a breach of this provision shall be fined from five hundred (500) to ten thousand (10,000) euros. In the fourth recurrence the authorization is temporarily revoked for a period of ten (10) days, while in the fifth recourse the authorization is definitively revoked by decision of the authority which granted it.

Anyone who violates the provisions of this section on tobacco advertising shall be fined from five hundred (500) to ten thousand (10,000) Euros in the event of a repeat infringement.

According to article 3 of Law 3730/2008, as supplemented by article 35 of Law 3896/2010, a violation of the prohibition on smoking in all types of cars, private and public use, when minors under 12 years of age, is required an administrative fine of EUR 1,500 to a passenger who smokes independently of a driver, and a fine of EUR 3,000 is doubled if a person who drives a public car. In addition, drivers of such vehicles shall be required to withdraw their driving license for one (1) month for each infringement, even if they have not committed the infringement themselves, but a person aboard the car.
